The answer, honestly, is I don't know about Caley. I'm sure I've seen people say either here or GQ that they aren't able to get promoted out of the Conference because they've reached their max attendance and they get some message about council not allowing them to expand. AFAIK for Scotland you are automatically upgraded though.

In CM4 the upgraded stadium is no longer an issue.

It doesn't happen, teams get promoted no matter what the stadium size.

Promotion for all in Scotland, I have seen Queen of the South promoted in my Gretna game.

If it happens in Scotland then it's totally unrealistic and another fault the programmers should fix. The SPL have very strict guidlines with regard to Stadia, including 10000 seats.
