1) Not as a rule. LLM frowns upon using "known" players, players you've used in the past and sign only because of this. If you come across a "known" player through scouting, then he's fair game.
2) Some of the LLaMa Zealots say this is the case. I tend to think it's a bit draconian, but again if they're scouted they're fair game.
Remember, though. It's your game, you bought it, play it like you want to, especially if you're only "loosely" following the rules.
Try it playing to the guidelines, it's a lot better in the long run.
Scouting loan candidates is a must, when you're at a higher league (e.g Div 2 ir 1), as you need quality instead of quantity. It's not that important when you're in conference.
I would like to ask a question on my part though: when looking for possible loan deals, you use the player search screen. Would you tick the "ask ass man to filter out unrealistic targets" on?

It would only take one phone call in the case of youngsters, and I'm sure the information would easily available as to who is likely to be allowed on loan.
I sometimes scout loan players and sometimes don't, but it depends on priorities and time. I don't know enough about the inner workings of RL football to know what kinds of player lists are available to managers and how much information they realistically have access to etc.
Most LLM clubs will only have one scout though, maybe 2 if you have a bad squad and need to invest more wages in scouting to improve the squad. Is it worth having that scout spending maybe a week watching some young player at a bigger club who has probably played in very few matches and can only be watched in training with a view to loaning him when your scout could be out looking for youth players or scouting in general? It's all down to priorities I guess - often I would take a chance on a loan signing if time isn't on my side.
As long as you can square what you are doing with some realistic interpretation I think it is fine. The total number of loan signings is limited so in game as in real life you pays your money and takes your chance - if you loan a donkey through having not scouted him you either have to make do or send him back having wasted a loan slot.
The issue of how you would know players are available for loan or not is a valid one, but like I said, I wouldn't pretend to know what information managers have access to IRL - one would assume though that if clubs really want their players to gain experience out on loan, they would make efforts to make that known around the leagues just below them.
