It's no use having a squad full of star players without a decent way for them to play their football.

Default conceding penalties

I like to use a tenacious middfielder with high tackling on DM position in a "destroyer" role, ie maximum closing down and tackling on hard. It works well for me but lately the DM has been causing a lot of penalty kicks after fouling in the penalty box (ussually finds himself there after a corner or a free kick).

Could this be due to his high tackling? Is there any way to solve this other than lowering his overall tackling? Maybe I can keep him out of the box somehow??

maybe his tackling stats are not great? would not suggest hard tackling for anyone with not outstanding tackling stats (at very least 15), exaclty for that reason.

You could instruct him to stay forward in set pieces instead of getting involved. I usually have my target man (good heading and jumping) to get involved in defensive set pieces and have a midfielder like the AMC stay forward.

Perhaps you should think about this since you are happy with his tackling everywhere else in the game but set pieces.
