I can't believe a consumer magazine has highlighted a consumer issue and had it backed up with the Office of Fair Trading so that it helps consumers.

If their system is sufficiently inefficient that every time this DD claims it runs through a complex and expensive series of actions then that's their faultfor having a rubbish system, not the customer's fault.

If you say so. The fact remains money is trying to come out of his account and there is no cash in there. Customer's fault not bank's.
Ps. Natwest won't refund even half those charges, but good luck all the same.

They are t*ssers. They've completely ignored the Law Society and decided to press on with their moronic suggestions that will quite frankly lower the standard of legal services on offer in Scotland significantly were they to be acted upon.
A simple matter of consulatation with the profession would have saved a lot of time and hassle, not to mention money for everyone.
They are blatantly labouring under the mistaken belief that cheaper = better, which when it comes to legal services could not be further from the truth. Ultimately it will lead to good lawyers doing more work for less money to make up for the "Tesco Law" practitioners with their conveyor belt mentality.

And the legal profession in Scotland had no means to put these points across? It was suddenly thrust upon them?
Which? doesn't generally just take a cheaper=better policy tbh - so I can't work out if you've jumped to that conclusion because they happen to not be fighting your corner.
I can't speak on their behalf btw... I'm not in the legal business.
Which? is fffffbbb for me, but then I'm not a Scottish lawyer am I? |

I agree & £38 is far too much. It will be reduced in the future I feel, much like when you miss a payment on your credit card, that was reduced down to £12

Which? is fffffbbb for me, but then I'm not a Scottish lawyer am I? | Of course the points will be put across, it's just more time consuming and costly to do it as a response to the complaint as opposed to during a period of consultation.
It's definitely a case of cheaper=better here. It really strikes me as ridiculous - who would rather pay £50 for an amateur job of a Will when they could get a professional to do it for about £100 and be secure in the knowledge it's done right and will accurately reflect their wishes?
Just as an example.

But who says its a rubbish system, the output of the checks done could be very valuable and create a much simpler and cost effective process at the banks end. obviously they need to cover the money somehow so rather than take it from all the customers they only charge those who activate the process.

Make a formal complaint.
You have two defences:
-They did not tell you about the charges. Although it is fair to expect someone to check their account regularly it is clear that you were completely unaware of the charges or the overdrawn amount else you would have dealt with it.
-Financial Difficulties. If this puts you into financial difficulties you can make a complaint on these grounds. These types of complaints are still being looked at by the Financial Ombudsman Service (where as bank charges are not).
