I had 1 or 2 problems with my 360 and never had a problem with my PS3. But not going to get into the whole ps3 v 360 debate. Horses for courses both are very good consoles and it's an individual choice.

i would have just taken it back to the shop that you bought it from if it messed up.

don't be fobbed off by them saying you have to contact the makers. that's their job.
you contact the shop get a refund, the shop contact microsoft.
