No it's not
They both come under section 5 of the Road traffic act 1988. You're only defence is to say that you had no intention of driving the car, get your mate in as a witness to back you up and hope the judge believes you.

similar happened to me we came home from nightclub to my mates house my car was parked there from earlier as i got ready at his house he wasnt in so we sat in car waitin cops drew up & although keys were in my pocket & my car was completely frozen ( it was december ) i got done with being drunk in charge of a vehicle 1 year ban nightmare!

barnsley - were you breathalysed?
Looking at the sentence guidelines - in charge/unfit through drink with excess alcohol, summary offence only, maximum penalty level 4 fine or 3 months custody. 10 points mandatory on licence and consider disqualification for contributory factors - resisting, refusing, uncooperative, consider rehabilitation course.
Average sentence - £360 fine, 10 points, possible rehabilitation course.

sounds like you might be a bit buggered then :/
and when i went to court I got suited and booted but not one other person was. All in tracksuits and caps and listening to ipods really loud. Chavtastic cuntfaces.
