Being asleep drunk in your car is a bit different to having the keys in your pocket when you're not even in town. Otherwise imagine the field day the police could have - just walk into a packed pub and arrest anyone who had their car keys on them |

I think you're in trouble, which seems harsh if what you're saying is right, but nonetheless magistrates get very cynical and your version of events, with minor changes, will have been heard by them loads of times before. So unless you can get evidence to back up what you're saying, I think you're looking at a conviction.

I'd think the evidence of himself and the friend would be enough, but you never know.

when the magistrate asked if you have anything to say, just go through your story again and that you can see why they nicked you but you had no intention of getting i the car, just couldn't find your keys etc blah blah. As long as you seem genuine and "shook up" by the whole court experience, they'll be more lenient in my experiences.
I was sh*tting myself when I had to stand up and talk, but just waffled on so much I think she got bored |

| In theory it ought to be but police evidence tends to be given much more credence.
