the thing was, my friend was staying with me and he usually would do since we were both off work and sit up and drink some more and watch some dvds there was no reason for me to go into my car - as my car was already at my house

barnsley - one or two things just seem a little odd. So for clarification:

i) Did you have the cds with you when the police stopped you?

ii) How far were you from the car/van when they stopped you?

iii) You say that it is after a Champions League match, so around 10.00pm. You and your mate decide to get some cds from your car/van and while there you decide to change your clothes; after spending some hours lounging around at home anyway, where presumably you would have had other clothes you could have changed into.

Why did you get you get changed in the car/van? - why not take the clothes back home to get changed. I have to be honest not, many people would leave a warm house after 10.00pm and go to their car/van to get changed, even if it was on the spur of the moment?

Why did your mate go with you? and what was he doing when you were getting changed? Was he in the car/van with you? (sounds more like gross indecency).

you won't get away with it unless you persist your story too solicitor and have your friend as a credible witness. i know through experience if a married couple both insured on the same car go shopping and the husband is drunk looks after the keys in car while wife does the shopping husband will get done for drink driving....harsh but true

From what I can remember, you have to be in "charge" of the vehicle to be done for drink driving. i.e. sitting in it with the keys in the ignitition.

Keep to your story (if it's the truth - they'll catch you out if you're lying ) and I can't see what they can do you for? Loitering?!

I got done for drink driving with a level of alcohol in my breath which could've been punished with custody, plus i wrote off the car I was driving, but it was my first offence etc so "just" got banned.

You'll be reet imo. Unless you're lying or you were a kunt to the police and give them reason to want to see you punished.

yeah shirley the fact the keys to the car were in your pocket and not in the ignition will work in your favour. I assume the police know the keys werent in the ignition?

I thought merely being drunk with the keys on you was enough to be done for being drunk in charge of a vehicle? I thought that was why it's not a good idea to sleep drunk in your car, because you could still technically drive off.
