Default The Electronic Communications Act - Accepting Terms and Conditions

Hi, hoping someone can point me in the right direction.

I can't be too specific, for confidentiality reasons, but I've been consulted by a client who are being chased for money by a company under the Electronic Communications Act. This is on the basis that they signed up for a free trial and didn't cancel in time, incurring an annual bill in just a few days.

Now, I'm sure reasonableness comes in here, and unfair bargaining positions, but if anyone knows of cases or sources that can help me research this, I'd appreciate it.

Thanks.

Have you got access to something like LexisNexis to search for such cases?

No. Otherwise I would use it!

I could go down to the Faculty Library, but it's just hard copies, so hours of searching for not a lot of fee.

Thanks.

Presume they'll raise it in the English Courts, so English cases are welcome.

Hmm, have only found two cases relating to the Act and they don't really appear to be relevant unfortunately.
