As it was a Champions League match, I'm pretty sure it falls outside the FA's jurisdiction.
Having said that, the FA should crack down on horror tackles, especially those like Barton's - who as a repeat offender should get a seriously lengthy ban.
I remember one weekend last season when there were two straight-red incidents:
1 - Paul Konchesky made a rash, last-ditch sliding challenge on the edge of the penalty area - his opponent went flying. If he had made contact with the ball, it would have been a perfect tackle (not from behind, not two-footed, studs down etc) - video evidence showed that Konchesky had in fact missed the ball AND the man!
With only two fit defenders eligible for their next match West Ham not surprisingly appealed.
2 - (iirc) Joey Barton hounded an opponent from the centre of the pitch to a wide position, costantly hacking at his heels and calfs. The player layed the ball off momentarily before Barton swept both his legs from beneath him - Barton then followed the ball to an opponent near the corner flag and launched a flying two-footed assault that me wince as contact was made.
The red-carded Barton was furious and made a heated remonstration at the referee before being escorted from the pitch.
Laughably Man City appealed!
Even more laughably, the FA dealt with both appeals on the same day, and upheld the original referee's decisions (despite one of them being wrong!)
Both players had the same punishment too - yet their "crimes" and behaviour couldn't have been more polar.
Did Kuyt ever get punished for his flying challenge btw?
